2. Account Registration and Responsibilities

2.1 Eligibility

• You will maintain the security of your Account by protecting your password and restricting access to your Account

You are responsible for all activities that occur under your Account. We are not liable for any loss or damage arising from your failure to safeguard your Account information. If you suspect any unauthorized use of your Account, you must notify us immediately.

2.3 Account Restrictions

• Create multiple Accounts without our prior written consent
• Transfer or sell your Account to another party
• Use another user's Account without their permission

Violation of these restrictions may result in suspension or termination of your Account.

3. Use of Services

3.1 User Conduct

You agree to use the Services in accordance with these Terms and all applicable laws and regulations. You shall not:

• Post or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, violating copyrights, obscene, or otherwise objectionable
• Infringe upon the intellectual property rights of others

3.2 Content Submission

By submitting content to the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of operating and improving the Services. You represent and warrant that you have the right to grant this license and that your content does not violate any third-party rights.

4. Buying and Selling

4.1 Listing Items

Sellers must provide accurate and complete descriptions of items or services offered, including pricing and any relevant terms. Each listing must be placed in the appropriate category and must not include any misleading information.

4.2 Prohibited Items

The following items and services are prohibited from being listed on the platform:

• Hacked or stolen accounts
• Beta codes, test software, or evaluation software
• Accounts, games and codes violating copyrights
• Redeemed or used codes
• Items involving duping, glitching, hacking, or modding
• Unauthorized advertisements directing users outside the platform
• Accounts without full email access (NFA accounts)
• Randomized or misleading listings
• Illegal items or services

4.3 Transaction Obligations

All offers made and accepted through the Services are binding. Sellers are obligated to deliver the purchased items or services promptly upon acceptance of an offer. Buyers are required to make timely payment for purchased items or services. Failure to fulfill these obligations may result in account suspension or termination.

4.4 Fees

We may charge fees for certain transactions or services provided through the platform. Applicable fees will be disclosed to you prior to the completion of a transaction. By completing a transaction, you agree to pay all applicable fees. We reserve the right to change our fee structure at any time, and we will notify you of any changes by posting the updated fees on our website.

5. Dispute Resolution

5.1 User Disputes

If you have a dispute with another user, we encourage you to resolve it amicably through direct communication. If you are unable to resolve the dispute, you may contact our support team for assistance. While we may attempt to facilitate a resolution, we are not obligated to resolve disputes between users.

6. Intellectual Property Rights

6.1 Our Content

All content and materials available on the Services, including but not limited to text, graphics, logos, and software, are the property of MIS or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Services without our prior written permission.

6.2 User Content

You retain ownership of any content you submit to the Services. By submitting content, you grant us a license to use your content as described in Section 3.2. You represent and warrant that you have the rights to your content and that its use does not violate any third-party rights.

7. Termination

7.1 Termination by You

You may deactivate your Account at any time through the account settings. Upon deactivation, you will lose access to any information associated with your Account.

7.2 Termination by Us

We reserve the right to suspend or terminate your Account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the platform.

8. Limitation of Liability

To the fullest extent permitted by law, MIS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Services
• Any conduct or content of any third party on the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any errors or omissions in any content or services provided

Our liability in all cases shall be limited to the amount you paid us for Services in the past six (6) months, or $50 USD, whichever is greater.

9. Indemnification

You agree to fully indemnify, defend, and hold harmless MIS, its affiliates, officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, and expenses, including but not limited to legal and attorney fees, arising from:

• Your violation of these Terms
• Your improper or illegal use of the Services
• Any content you submit, post, or share through the Services
• Your transactions, disputes, or interactions with other users

If we are subject to a claim due to your actions, you agree to compensate us in full.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Lithuania, without regard to conflict of law principles.

10.2 Dispute Resolution Process

Before initiating legal proceedings, you agree to first contact our support team to attempt to resolve any disputes informally. If a resolution cannot be reached, we will lead by our limitations of liability as described in section 8.

11. Privacy and Data Protection

Our collection and use of personal data are governed by our Privacy Policy. By using our Services, you consent to the collection, storage, and processing of your personal information as described in our Privacy Policy.

User Responsibilities for Data Protection:

• You must ensure that your shared data with other users is accurate and secure
• You are solely responsible for securing your login credentials and private information
• We are not responsible for any data breaches or leaks caused by your negligence

If you suspect unauthorized access to your personal data, it is your responsibility to take action immediately.

By using third-party services through our platform:

• You acknowledge all risks associated with interacting with them

13. Miscellaneous Provisions

13.1 No Waiver

Failure to enforce any provision of these Terms shall not be considered a waiver of our rights.

These Terms, along with our Privacy Policy and any other applicable policies, constitute the entire agreement between you and us regarding the use of our Services.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign our rights and obligations without restriction.

13.5 Force Majeure

We shall not be held responsible for any delays, failures, or damages caused by events beyond our reasonable control, including but not limited to natural disasters, war, cyberattacks, government actions, or network failures.
